v. Wisniewski
2009 Ohio 6158 - Ohio: Court of Appeals, 3rd Dist., Hancock 2009
This case involves a LNC who sued the attorney who hired her for services but
failed to pay for the services. The LNC sued in small claims court.
The attorney filed a motion to transfer the case to the general district court.
The court denied the motion and set a date for trial. The attorney failed
to appear for the trial. The court ruled in favor of the LNC and awarded
her the full amount owed plus cost and interest. The attorney appealed. The
appellate court affirmed the lower court. This is an excellent case for
LNCs pursuing actions for collection of fees owed. It is not good news for
attorneys who refuse to pay for services.
